Of course, almost all free software is copyrighted, but the statement “You only have the right to use it or distribute it as a bundled, integrated product.” makes DNSsafe non-free (although the exact license/EULA is unclear).

…So I’m a little confused. More research is probably needed.
However, one easy thing to do may just be to remove bind 8. The COPYRIGHT file for bind9 makes no mention of DNSSafe, and entry 464 in the changelog file shows that the code is being built against the openssl RSA implementation instead. JustinBaugh? July 18, 2007, at 05:15 PM
